Terms & Conditions – The Modern Homepage

By checking the box on this page, you (“Client”) agree to retain Mark Brinker & Associates, Inc. (“Consultant”) to provide consulting, copywriting, design, and website strategy services packaged as The Modern Homepage, and agree to the following terms and conditions:

SCOPE OF WORK
During this engagement, Consultant will review the Client’s existing website and information provided through the Modern Homepage intake process, then create one complete, personalized homepage blueprint for the Client’s business.

The Modern Homepage blueprint will include the recommended homepage copy, page structure, calls to action, trust elements, and overall visual direction needed to show the Client what their new homepage should say and how it should look.

Consultant will also record and deliver a private Behind the Scenes with Mark video explaining the thinking behind the major decisions in the completed homepage blueprint.

The Modern Homepage includes one completed homepage direction created specifically for the Client’s business. Alternate concepts, alternate designs, and additional homepage versions are not included.

The work will be completed personally by Mark Brinker on behalf of Consultant and will be performed remotely.

PAYMENT TERMS
The current standard investment for The Modern Homepage is $595 USD, payable in full at purchase.

Consultant might also offer an installment payment option. Any pricing and payment options presented at checkout are binding once selected.

If the Client selects an installment payment option, the installment plan represents one purchase divided into scheduled payments and is not a monthly subscription or cancel-anytime service. Once the refund period described below has expired, the Client remains responsible for all remaining scheduled payments.

CLIENT INTAKE & PROJECT EXPIRATION
After purchase, the Client will receive an intake form requesting the information Consultant needs to complete the Modern Homepage.

The Client should submit the completed intake form and requested information within 10 calendar days of purchase.

All information and materials reasonably required to begin the project must be received by Consultant no later than 30 calendar days after purchase.

If Consultant has not received the completed intake form and all required information within 30 calendar days of purchase, the project will be considered permanently closed.

Once a project is permanently closed:

- No refund will be issued.
- Consultant will have no further obligation to complete or deliver the Modern Homepage.
- The project cannot be restarted under the original purchase.
- If the Client later wishes to purchase a Modern Homepage, a new order must be placed at the then-current price and subject to Consultant’s availability.

DELIVERY
The completed Modern Homepage blueprint and private Behind the Scenes with Mark video will be delivered within 10 business days after Consultant has received the Client’s completed intake form and all information reasonably required to complete the project.

If additional information or clarification is required, the 10-business-day delivery period will not begin until Consultant has received the information necessary to proceed.

Delays by the Client in providing requested information might delay completion of the project.

REVISIONS & FACTUAL CORRECTIONS
The Modern Homepage includes one completed homepage direction. Revisions, alternate concepts, alternate designs, or changes based on subjective preferences are not included.

The Client has 7 calendar days after delivery to send Consultant one consolidated email identifying any factual corrections needed.

Factual corrections include items such as:

- Misspelled names
- Incorrect credentials
- Incorrect contact information
- Inaccurate service or business details
- Information provided by the Client that Consultant accidentally omitted or stated incorrectly

Requests to change the strategy, messaging direction, page structure, copy style, visual direction, design preferences, or other subjective elements are not considered factual corrections.

Consultant will make valid factual corrections that fall within the scope described above.

After the 7-calendar-day correction period has expired and any valid factual corrections have been completed, the project will be considered complete and permanently closed.

WEBSITE IMPLEMENTATION
The Modern Homepage is a homepage blueprint and consulting deliverable.

Website coding, development, programming, and implementation on the Client’s live website are not included.

The Client can implement the completed blueprint themselves, have someone on their team implement it, or provide it to their website professional.

Consultant is not responsible for errors, changes, functionality problems, design differences, or other issues introduced when the Modern Homepage blueprint is implemented or modified by the Client or any third party.

CLIENT-PROVIDED INFORMATION
The Client is responsible for providing accurate and complete information about their business, services, credentials, customers, offers, and other details requested during the intake process.

Consultant will rely on the information provided by the Client when creating the Modern Homepage.

The Client is responsible for reviewing the completed blueprint and notifying Consultant of factual inaccuracies within the 7-calendar-day correction period described above.

INTELLECTUAL PROPERTY
All business information, written materials, photographs, logos, trademarks, and other content supplied by the Client remain the property of the Client or their respective owners.

Upon full payment, the Client can use, reproduce, modify, and implement the completed Modern Homepage blueprint for the Client’s own business purposes.

Consultant retains ownership of its underlying processes, methodologies, frameworks, templates, systems, and proprietary methods used to create the Modern Homepage.

The Client cannot resell, redistribute, license, or represent Consultant’s underlying processes, methodologies, templates, or proprietary materials as their own.

PUBLICITY & PORTFOLIO
Client agrees that Consultant can reference the project in marketing materials, portfolio showcases, case studies, or educational demonstrations.

This might include screenshots, before-and-after examples, portions of the completed homepage blueprint, or general descriptions of the work performed.

Sensitive or confidential business information will not be disclosed.

REFUNDS & CANCELLATIONS
The Client can request a full refund within 7 calendar days of purchase, provided:

1. The Client has not submitted the completed intake form; and
2. Consultant has not begun work on the Modern Homepage.

The refund period ends when either of those conditions is no longer satisfied or when 7 calendar days have passed after purchase, whichever occurs first.

After the refund period has ended, all payments are non-refundable.

Refunds will not be issued because of changes in the Client’s business direction, priorities, preferences, circumstances, or decision not to proceed with the project.

Failure to submit the completed intake form and required information within 30 calendar days does not extend the refund period. If the project expires because the Client fails to provide the required information within that timeframe, the project will be permanently closed and all payments will be forfeited.

If the Client selected an installment payment option, expiration or closure of the project because of the Client’s failure to provide the required information does not cancel any remaining scheduled payments.

If Consultant determines that it is unable to complete the Modern Homepage project, Consultant will refund amounts paid for the project that Consultant is unable to deliver.

DISCLAIMER
Consultant does not guarantee any specific financial, marketing, sales, lead-generation, search-engine, conversion-rate, or other business results from The Modern Homepage.

The Modern Homepage represents Consultant’s professional recommendations based on the Client’s website, business information, and circumstances at the time the work is performed.

Results depend on many factors outside Consultant’s control, including how the blueprint is implemented, the Client’s products and services, market conditions, traffic, marketing, sales process, and customer behavior.

Consultant’s responsibility is limited to delivering the Modern Homepage blueprint and Behind the Scenes with Mark video consistent with the project scope described in these terms.

ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between Client and Consultant regarding The Modern Homepage and supersedes all prior discussions, representations, or understandings concerning the services covered by this Agreement.
